Judicial Emergency Expiring in

the Superior Court of Cobb County

 

September 26, 2024 – The Judicial Emergency declared by Chief Judge A. Gregory Poole of the

Cobb Judicial Circuit on August 7, 2024, and extended on August 28, 2024, will expire at 9:05

AM on Sunday, October 6, 2024. All deadlines and filing requirements will resume at that time,

including all statutes of limitations; the time within which to file a writ of habeas corpus; the

time within which discovery or any aspect thereof is to be completed; the time within which to

serve a party; motions for new trial; Answers in civil cases; the time within which to appeal or to

seek the right to appeal any order, ruling, or other determination of a judge of the Superior Court

of Cobb County; and any other legal proceedings that have been authorized for emergency relief.

On September 24, the Superior Court Clerk’s Office advised Chief Judge Poole that the backlog

of all documents is now fully indexed into the new Icon case management system. Chief Judge

Poole appreciates the Clerk’s Office’s diligence in working through the backlog issue. Though

the Chief Judge remains concerned about other issues arising within the Clerk’s Office, he is

comfortable allowing the Judicial Emergency to expire.

 

The Court also appreciates the professionalism and understanding shown by the attorneys and

litigants during this emergency period. Chief Judge Poole also notes that the Emergency Notice

did not impact the State Court, Juvenile Court, Magistrate Court, or Probate Court of Cobb

County or any of the several municipal courts within Cobb County. The emergency was separate

and unrelated to the Clerk of State Court. He continues to appreciate all the judges and clerks in

the other classes of courts as they continue to administer justice in Cobb County.

 

The Chief Judge asks that this press release be published, posted, transmitted, or otherwise

announced such that all the parties affected, their counsel, and the public are made aware of the

expiration of the Judicial Emergency.
